1. Acceptance of terms

Babel42 is operated by Babel42 Ltd, a company registered in England and Wales under company number 17269551(“we”, “us”). By accessing or using Babel42 (this website or the application) you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use Babel42.

2. YouTube Terms of Service

Babel42 uses the YouTube Data API v3. By using Babel42’s YouTube features, you additionally agree to the YouTube Terms of Service. YouTube is a trademark of Google LLC. YouTube content displayed in Babel42 is retrieved directly from the YouTube Data API; we do not host or redistribute it in violation of YouTube’s Terms.

3. Other third-party platforms

Babel42 also collects public data from other platforms (including X, Instagram, Bluesky, Mastodon, Tumblr, Hacker News, DEV.to and news sources). Your use of data obtained from each platform is subject to that platform’s own terms of service and acceptable-use policies, and you are responsible for complying with them. We may add, change or remove supported platforms at any time as their APIs and terms allow.

4. Permitted use

Babel42 is a social-listening tool for monitoring public mentions of keywords and public accounts for personal or business-intelligence purposes. You may not use Babel42 to:

• Scrape or mass-download platform data in violation of those platforms’ terms.
• Conduct surveillance, harassment, stalking, or profiling that produces legal or similarly significant effects about an individual.
• Violate applicable law, including data-protection and intellectual-property law.
• Resell, redistribute or sublicense the raw platform content except as permitted by the source platform.

5. Subscriptions, billing & refunds

Paid plans and the optional X add-on are billed in advance through our payment processor (Stripe) on a recurring monthly or annual basis at the price shown at checkout. Subscriptions renew automatically at the end of each billing period until cancelled.

• Upgrades take effect immediately and are charged a prorated amount for the remainder of the current period; you authorise this charge at confirmation.
• Downgrades and cancellations take effect at the end of the current billing period: you keep your current plan and any add-on until then, after which the account reverts to Free. Fees already paid for the current period are non-refundable except where required by law.
• Cancel any time from account settings or the billing portal; cancellation stops future renewals.
• We may change prices; changes apply from your next renewal and we will give reasonable notice.
• Failed payments may lead to suspension after a short dunning period; usage quotas and add-on budgets reset at the start of each billing cycle and do not roll over.

If you are a consumer in the UK or EEA you may have a statutory right to cancel within 14 days of purchase. By starting to use the paid service immediately you ask us to begin during that period and acknowledge you may lose that right once the service has been fully provided. Nothing here affects your non-excludable statutory rights.

6. Account responsibilities

You are responsible for maintaining the security of your account credentials and for all activity under your account.

7. Data accuracy, completeness & refresh

Babel42 depends on third-party platform APIs, which impose rate limits, quotas, sampling and coverage restrictions outside our control. Accordingly:

• We do not guarantee to capture every post, mention or account matching your query. Results may be incomplete or sampled.
• Collection is not real-time. Refresh frequency varies by plan, platform and load, and data may be delayed, throttled, or temporarily unavailable.
• Historical backfill depth varies by plan and by what each platform’s API makes available; some platforms only return recent data.
• Reach, follower/subscriber counts, engagement, influence and similar figures are approximate estimates, not guaranteed-accurate measurements.

8. Automated analysis & AI

Sentiment classifications, inferred attributes and other automated analytics are produced by AI/automated models and are estimates that may be inaccurate. They are provided for general insight only; you should not rely on them as the sole basis for any significant decision. See our Privacy Policy for how this analysis is performed.

For the AI Visibilityproduct specifically, brand appearances, share of voice, sentiment and cited sources are derived by probing AI assistants and reflect those models’ outputs at the time of each run; results vary between runs and models. Cited sources are captured from the opening research prompt of each buyer journey, for the models that perform live web search (Perplexity, ChatGPT and Google Gemini); follow-up turns are not used for citations. Other selected models (including Claude and Grok/xAI) answer from model knowledge without live web search and therefore return no citations. The absence of citations for a given model reflects this design and is not an error or an indication that no sources exist.

9. No professional advice

Babel42 is a social-listening and research tool. Nothing it provides is professional, legal or financial advice. Any references to monitoring companies, markets or investments are for informational purposes only and are not investment advice.

10. Service availability & warranty disclaimer

Babel42 is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted or error-free operation. This does not affect any statutory rights you have as a consumer that cannot be excluded by law.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the 12 months before the event giving rise to the claim.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for your statutory rights under the Consumer Rights Act 2015.

12. Indemnification

You agree to indemnify and hold us harmless from claims, damages and costs (including reasonable legal fees) arising from your use of Babel42, your content or queries, or your breach of these terms or of any third-party platform’s terms. This does not apply to the extent a loss results from our own breach or negligence.

13. Intellectual property

Babel42, its software, design and trademarks are owned by us or our licensors. Collected platform content remains the property of its respective owners and the source platforms; these terms grant you no rights in that content beyond using the service as intended. We grant you a limited, non-exclusive, non-transferable right to use Babel42 during your subscription. Other names and logos referenced are the property of their respective owners and used for identification only.

14. Termination

We may suspend or terminate your account for breach of these terms. You may delete your account at any time; see our Privacy Policy for how data is deleted.

15. Changes to these terms

We may update these terms from time to time. We will revise the “last updated” date and, for material changes, notify account holders. Continued use after changes take effect constitutes acceptance.

16. Governing law & disputes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law gives you other rights.
